The terms that apply when you use this website, book a consultation, or purchase services, packages, memberships, or gift cards from us.
ACCEPTANCE OF THESE TERMS
These Terms and Conditions govern your use of this website and the services offered by Everyday Beauty Med Spa. By using the site, booking an appointment, purchasing a package, gift card, or membership, or submitting a form, you agree to these terms. If you do not agree, please do not use the site or book services.
NO MEDICAL ADVICE
The content on this website, including treatment descriptions, guides, articles, and before and after imagery, is for general informational purposes only. It is not medical advice, does not create a provider patient relationship, and is not a substitute for an in person consultation, examination, and treatment plan. Never delay or disregard advice from a qualified provider because of something you read here. If you are experiencing a medical emergency, call 911.
CONSULTATIONS, ELIGIBILITY, AND CONSENT
All medical aesthetic and weight loss services require a consultation and, where applicable, review and approval by a licensed provider. Not everyone is a candidate for every treatment. We may decline or discontinue a service if it is not clinically appropriate, if required health history or lab work is incomplete, or if you are pregnant, nursing, or have a contraindication. You must be 18 or older to receive treatment on your own behalf, and you agree to give complete and accurate health information. Written informed consent is required before treatment.
NO GUARANTEE OF RESULTS
Individual results vary and cannot be guaranteed. Outcomes depend on your anatomy, health history, adherence to aftercare and program instructions, lifestyle, and the number of sessions completed. Photographs and testimonials on this site reflect the experience of specific individuals and are not a promise of any particular outcome. Additional sessions or maintenance treatments may be needed and are charged separately unless stated otherwise.
APPOINTMENTS, DEPOSITS, AND CANCELLATIONS
Bookings are subject to our Appointment Policies, which cover deposits, cancellation and rescheduling windows, late arrivals, no shows, and guests. Those policies are incorporated into these terms by reference and are available on our Appointment Policies page. Deposits and cancellation fees may be non refundable as described there.
PRICING, PROMOTIONS, AND PAYMENT
Prices shown on this site are subject to change and may not include applicable taxes or add ons. Where pricing varies, final pricing is confirmed at consultation. Promotions, event specials, and memberships are valid only for the stated dates, cannot be combined unless we say so, have no cash value, and may include expiration windows for redeeming services. We make reasonable efforts to keep the site accurate, and we reserve the right to correct errors in pricing or descriptions and to decline or cancel an order placed based on an obvious error.
PACKAGES, MEMBERSHIPS, AND GIFT CARDS
Prepaid packages and series are for the named client, are non transferable unless we agree in writing, and must be redeemed within any stated period. Memberships bill on a recurring basis until you cancel according to the terms provided at signup. Gift cards are redeemable for services and eligible products, cannot be redeemed for cash except where required by law, and are not replaced if lost or stolen. All sales of services, packages, memberships, and gift cards are final and non refundable except where required by law.
PRODUCTS AND RETAIL
Retail and professional skincare products may be returned only if unopened and unused, within the period stated at the time of purchase, with proof of purchase. Prescription items and medications cannot be returned. Always follow product instructions and your provider's guidance.
THIRD PARTY FINANCING AND BOOKING PLATFORMS
We offer links to third party financing and booking providers as a convenience. Applications, approvals, payment plans, interest, fees, and any resulting agreement are solely between you and that provider. We do not make credit decisions and are not responsible for the acts, omissions, terms, or privacy practices of third party providers.
AFFILIATE AND REFERRAL PROGRAMS
Participation in our affiliate or referral program is subject to approval and to the program terms provided at enrollment, including how referrals are tracked, commission or credit amounts, payout timing, and required disclosures. You agree to represent our services honestly, to disclose your affiliate relationship as required by law, and not to make medical claims or promises of results. We may modify, suspend, or end the program, or remove a participant, at any time.
TEXT MESSAGE AND MARKETING CONSENT
By providing your phone number you consent to receive calls and texts related to your inquiries and appointments. Marketing messages require separate opt in, and consent is not a condition of purchase. Message frequency varies, message and data rates may apply, and you may reply STOP to opt out at any time.
WEBSITE USE AND INTELLECTUAL PROPERTY
All content on this site, including text, photography, logos, brand names, and design, is owned by us or our licensors and is protected by copyright and trademark law. You may view and print pages for your personal, non commercial use. You may not copy, scrape, republish, or use our content or marks for commercial purposes without written permission, and you may not attempt to disrupt, overload, or gain unauthorized access to the site or its systems.
REVIEWS, PHOTOS, AND SUBMISSIONS
If you submit a review, comment, photo, or other content to us, you grant us a non exclusive, royalty free right to use, display, and reproduce it in our marketing, and you confirm you have the right to grant that permission. We may take clinical photographs for your medical record. We will not use your identifiable photographs in marketing without your separate written authorization, which you may revoke going forward at any time.
DISCLAIMERS AND LIMITATION OF LIABILITY
The website and its content are provided on an as is and as available basis without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non infringement. To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data, arising from your use of the website or reliance on its content. Nothing in these terms limits liability that cannot be limited under applicable law, and these limitations do not apply to claims arising from the professional care we provide, which are governed by Arizona law.
INDEMNIFICATION
You agree to indemnify and hold harmless Everyday Beauty Med Spa, its owners, employees, and contractors from claims, damages, and expenses, including reasonable attorney fees, arising from your misuse of the website, your breach of these terms, or content you submit to us.
ACCESSIBILITY
We are working to keep this website usable for as many visitors as possible. If you encounter a barrier or need help accessing information or booking a service, contact us and we will help you directly and work to correct the issue.
GOVERNING LAW AND DISPUTES
These terms are governed by the laws of the State of Arizona, without regard to conflict of law rules. Any dispute relating to the website or these terms will be brought in the state or federal courts located in Maricopa County, Arizona, and you consent to that jurisdiction and venue. If any provision is found unenforceable, the remaining provisions stay in effect.
